In an interview situation, it is a violation of the Americans With Disabilities Act to ask a candidate if he/she has a disability. In addition, assuming disability - or whether someone will or won't need an accommodation - is also inappropriate. An interview should always focus on the candidate's skills and qualifications (i.e., what he/she brings to the table). It is good management/hiring practice in the beginning of an interview to ask all candidates if he/she has read the job description - and feels he/she can perform the essential functions of the job with or without a reasonable accommodation.
