Can an employer ask an employee with TBI or PTSD to submit to a medical examination?
Yes, if the need for the medical examination is job-related, consistent with business necessity, is conducted after an offer has been made, and is required of all new hires (regardless of disability). People with TBI, PTSD or any disability do not have to submit to a medical exam, simply because they have a disability or answer any medical questions until after they have been conditionally offered a job - and if done for all employees.
